General terms and conditions

These general terms and conditions of the Grapak Online Store are prepared in accordance with the Consumer Protection Act (ZVPot), the Electronic Commerce Market Act (ZEPT) and the Personal Data Protection Act (ZVOP-1).

They determine the operation of the online store, rights of users and the provider-buyer business relationship.

By issuing an order to purchase selected products at our website, you agree with the general terms of cooperation and purchase.


Terms of purchase on the website www.shop.grapak.com     

The buyer confirms that he/she has read and acknowledges the General terms of the online store at the www.shop.grapak.com (hereinafter: Terms) in its entirety.

Online sales at www.shop.grapak.com are carried out by the company Grapak A1 d.o.o., Tržaška cesta 515, 1351 Brezovica pri Ljubljani, registered in the court register at the Ljubljana District Court under Srg 79/2004 dne 29.4.2004. Grapak A1 is liable to pay VAT (ID for VAT:SI SI43101640).

The www.shop.grapak.com online store enables online purchase of hand tools and consumables for the industry, as is evident from the display on the subpages of the sales program, which is also presented in the main menu. At the www.shop.grapak.com website, you find our entire offer, product information and prices. Terms of purchase are determined in accordance with the Consumer Protection Act.


Ordering

Purchase at the www.shop.grapak.com online store may be carried out as a guest or a registered user. In both instances, our database records data on the user's purchase. The registration process may be performed during the purchase steps or separately in the Registration subpage. By registering, a user is provided with his/her user name, which is identical as the email, and a password. The user name and password indisputably determine a user and connect him/her with the entered data. Registered users are then able to view their purchase history and user account data. User account data may be at any moment changed by each user by logging in. Only the email address can not be changed. If a user wishes to change his/her email address, then a new user account needs to be created via the registration process. Protection of personal information is described in a separate paragraph.

Before each purchase, a user needs to login to the online store with the user name and password that were provided during registration, and after logging in to the online store, a user may change, update and inspect his/her data (address, password, past orders, etc.) via the My account tab

When viewing the offer, a user chooses the "Add to cart" option next to selected products. Selected products gather in the cart (tab in the upper right corner) and a user may at any time inspect and change it (change quantity and/or remove from the list). An order is finalised by clicking the "Checkout" button, where a user inspects the list of selected products. In the cart, a user performs the entire purchase in 3 steps:

Step 1: a user inspects his/her order (list and quantity of products) and potentially modifies it, in which case the price in the cart automatically changes. This step enables a user to insert a promo discount code, which he/she beforehand received from the provider, and thus take advantage of an additional discount. The discount is added by clicking "Confirm" after entering the promo code. Promo codes may be have limited time of validity, quantity and value.

By clicking the "Continue with order" button, a user proceeds to step 2 of the purchase process.

Step 2: selecting means of purchase. Options are Purchase without registration and Login via existing Grapak account or Register.

In case of purchasing without registration, a user performs the purchase as a guest, meaning that in the following steps he/she only enters data, which are required for issuing the order. This means that no user account has been created during the purchase, which would enable later login to the online store.

If a user has registered beforehand, in this step he/she may select login via existing account. In case of forgotten password, a user may reset it by clicking "Forgot password?". Otherwise, any new user may register by entering his/her email address and desired password (2x) and clicking "Register" to proceed to the next step.

Step 3: a user enters email information, selects type of delivery (personally collect it at the Grapak store location or via delivery service (cost of delivery will be displayed before issuing the order)), enters personal information (name and surname), information for delivery (address, postcode, city, country) and telephone number. If a user wishes an invoice to be sent to his/her company, then he/she must check this box and add company information (title, tax No. and VAT information).

A user proceeds to the next step by clicking the "Continue to payment" button.

Step 4: the user selects a payment method (by proforma invoice, on delivery,or Paypal), checks that he/she agrees with the general terms and conditions and finalizes the purchase by clicking "Confirm" to implement the order. A user sees a purchase confirmation and also receives an email confirming the purchase with a purchase summary to the email address, which was entered in the cart. With options credit card or Paypal, the user is directed to an interface to complete the purchase and after a successful payment, the user sees a purchase confirmation page. An email with a purchase summary is also sent.

Upon user confirmation and implementation of the order in Step 4 of the purchase process, Grapak sends an email confirming the order.  

Prior to confirmation, Grapak A1 d.o.o. reviews the order and withholds the right to decline it, if the product is no longer in stock or if there is an obvious mistake in price, which might occur during automated transfers. In each case, the user shall be notified as soon as possible. In case of discrepancies, data checks or for guaranteeing accurate delivery, Grapak A1 d.o.o. may phone the buyer on the number, entered in the cart.

The purchase agreement between Grapak A1 d.o.o. and the buyer is concluded at the moment when Grapak A1 confirms the order. From that moment on, all prices and other terms are fixed and apply to Halder and the buyer. The buyer is understood as a person with information, which were stated during ordering. Later modification of buyer information is not possible. By issuing an order, the buyer is held viable for the accuracy of stated information and also confirms the terms and conditions, as well as irrevocably and exclusively acknowledges them as a component of the order.

A confirmed order or signed contract is stored in electronic form at the seat of Grapak A1  d.o.o., Tržaška cesta 515, 1351 Brezovica pri Ljubljani.

The buyer may acquire a copy of the contract by an email request sent to info@grapak.com or by phone to (0)4 277 2700.

Costs, related to the using means of communication during ordering do not differ from the standard rate. 


Material defects, complaints, servicing and warranty

In accordance with the ZVPot act, Grapak A1 d.o.o. bears responsibility for material defects on goods.

The buyer must inform Grapak A1  about potential material defects within two moths after discovering a defect and attach a detailed description of the defect, as well as enable inspection of goods. Grapak A1 does not bear responsibility for material defects on goods, which are discovered after the period from acceptance, as determined by law.

The right to enforce material defects on goods is further determined by the provisions of the Consumer Protection Act.

Halder is aware of the importance of complaints and we therefore do our best to solve them as soon as possible to mutual satisfaction and in accordance with applicable legislation.

Complaints (return of incorrect, incomplete or damaged goods) are to be reported by email to info@grapak.com or by phone to (0)4 277 2700.

After confirmation or additional coordination with you, we will organize delivery via Pošta Slovenije or any other provider or agree on acceptance at one of our sales centres. Please include a copy of the original invoice to the goods.

Products include a warranty, if it is stated so on the warranty sheet or receipt. The product provider guarantees quality or flawless operation during the warranty period, if the product is used in accordance with its purpose and included instructions. Warranty deadlines are stated on warranty sheets or on receipts and commence as of the date of acceptance by the buyer. The form for returning goods is located here (in preparation).

The period in which the provider must, upon payment, provide repairs, maintenance and spare parts is at least 3 years after the warranty deadline.

Grapak A1 has its own service centre at the seat of the company at Strahinj 155, 4202 Naklo, which makes us qualified for technical assessment in case of potential malfunctions and independent in deciding regarding complaint resolution, replacement of faulty products, except if stated otherwise.

When claiming warranty, the buyer must return the goods, including a warranty sheet and the receipt, stating the date of purchase, serial number and warranty period for individual products.

The warranty period for a product, which the customer returns or sends back to Grapak A1 for repairs or replacement, lasts as long as is stated on the warranty sheet. This period begins as of the date stated on the receipt or the warranty sheet. Malfunctions or damage arising from improper use of equipment, provided by Grapak A1 are not covered by the warranty agreement.

Grapak A1 provides quality and speed in repairs. We exclusively use spare parts of original suppliers.


Prices

All prices are in EUR and include VAT, which is also clearly stated on the receipt. Prices and other benefits (e.g. discounts) apply at the time of issuing an order and are without predetermined validity. Stated prices apply only for purchases via the Grapak Online Store and for the below mentioned payment methods under the stated conditions.

Grapak A1 reserves the right to daily price changes without prior notice.

In case the price is not correct or it changes during order processing, Grapak A1 enables the buyer to cancel the order.


Payment Methods

Regardless of the selected payment method, the buyer receives a receipt for the purchased products by email (in .pdf) immediately after package delivery or in physical form upon acceptance.

The online store at www.shop.grapak.com offers the following payment methods:

  • On delivery (the buyer covers delivery costs),
  • by proforma invoice**, which is printed immediately after purchase,
  • or by Paypal.

When paying by credit card online, in case of order cancellation or change of payment method by the user, please notify us at info@grapak.com or at 04 2772707 for a chargeback or refund.

**After receiving payment by an offer/proforma invoice, the order is first processed. 

When selecting payment by a proforma invoice, you will receive an email with information for payment: amount, transaction account, reference and payment method. In this case, you will pay the ordered goods with a universal payment order (UPN form) at a bank, post office or online. After completing payment, you may send us payment confirmation to info@grapak.com for faster processing of your order. The received proforma invoice needs to be settled within 3 workdays, otherwise Grapak A1 cancels the order.

Payment to Grapak A1's current account is to be settled on the basis of data, which the user receives in case of payment by proforma invoice. 


Delivery and Acceptance

Ordered goods, which is in stock, will be prepared for delivery within 3 workdays after receiving an order or after receiving payment in case of proforma invoices, unless marked otherwise. Holidays and weekends may prolong delivery times and we ask for your understanding. If the ordered goods are currently not in stock, we will inform you by email or telephone.

Delivery is carried out by Pošta Slovenije or any other provider. If you are not home in time of delivery, you may accept the ordered products in accordance with the policy of the delivery provider.

Goods, purchased in the online store at www.shop.grapak.com may also be personally collected at the Grapak A1 store, at Strahinj 155, 4202 Naklo, during work hours. The purchase process is identical as for other products. Mark "Collect at the store" in the Type of delivery tab.

The buyer is obliged to visually and numerically inspect the goods before collection and record potential visual damage on the packaging or the goods. A complaint notification email must immediately be sent to info@grapak.com or communicated in person at PSC Grapak A1.


Delivery costs, receipt

Packaging and delivery costs are to be settled by the buyer. Costs are determined according to the relevant price list and weight of the shipment. Cost of delivery will be calculated and presented separately before issuing an order. VAT is included in the price of delivery.

Packaging and delivery costs are already calculated upon purchase at www.shop.grapak.com. 

The buyer receives goods to his/her address in accordance with the policy of the delivery provider.

When accepting the delivered goods, the buyer also receives an original receipt with all data and in accordance with the sales conditions, published on this site and confirmed upon issuing an order.

After shipping ordered products, the Agromehanika company may also, if requested by the buyer, send the receipt by email.

In case of personal collection at the collection point (PSC Tržaška cesta 515, Brezovica pri Ljubljani, 1351 Brezovica pri Ljubljani), the buyer receives a printed receipt for purchased goods upon collection.

The receipt includes the price separately from all other costs regarding the purchase.

The buyer is obliged to inspect the accuracy of data before issuing an order, since Grapak A1 will not consider later complaints regarding accuracy of issued receipts.


Withdrawal from the contract

Consumers have a right to withdraw from the contract without stating a reason within 14 days since accepting goods by sending written notification on withdrawal (applicable only for natural persons, who purchase a product for non-profit purposes).

To evoke the right to withdraw, the consumer must send an unambiguous statement to Grapak A1 d.o.o (Tržaška cesta 515, Brezovica pri Ljubljani, 1351 Brezovica pri Ljubljani, email info@grapak.com, telephone: 04 2772707) about his/her decision to withdraw from the contract in writing by mail, fax or email.

Consumers may do so by using the sample withdrawal form, which is available here (in preparation).

In case withdrawing from the contract, the consumer bears direct costs of returning goods.

If goods were already accepted by the consumer, he/she must return them to Grapak A1 within 14 days since the sent notice on withdrawal from the contract (purchase). Returned goods must be intact and in original quantity and packaging (also intact), attached with all relevant documentation and a copy of the original receipt.

Grapak A1 refunds the purchasing price within 14 days since receiving notice on withdrawal. Grapak A1 is entitled to delay the refund until we receive the returned goods or until the consumer submits evidence of shipping goods back.

The right to refund the purchasing price in cases of claiming warranty and material defects are further determined by the provisions of the Consumer Protection Act.


Complaints and disputes

Grapak A1 complies with applicable consumer protection legislation and will do its best to provide an effective complaints system.

In case of any issues, the buyer may contact Grapak A1 by telephone at 04 2772707 or by email at info@grapak.com.

The complaint processing process is confidential.

Within 5 workdays, Grapak A1 will confirm receiving the complaint and inform the buyer on the duration and course of processing.

Potential disputes, which would arise from the use of the Grapak A1 Online Store between the buyer and Grapak A1, shall be solved by both parties in an amicable manner. If they are unable to do so, the dispute is to be submitted to the competent court in Ljubljana.

Grapak A1 does not recognize any out-of-court consumer dispute resolution contractor as competent to resolve a consumer dispute that could be initiated by a consumer under the Out-of-Court Settlement of Consumer Disputes Act.


Protection of personal information

By entering into a purchase agreement, you consent to the storage and use of your personal information solely for the purpose of fulfilling the order (sending promotional materials, offers, invoices, news updates) and other necessary communication.

Grapak A1 undertakes to handle all obtained personal data in accordance with the Personal Data Protection Act (adequate protection against loss, destruction, forgery, manipulation and unauthorized access or disclosure by third parties). Despite the appropriate technical and organizational procedures to protect the information we collect, Grapak A1 is unable to exclude potential misuse of data, since the Internet is an unpredictable medium, despite security measures and security communication protocols.

The user is also responsible for the protection of personal data by ensuring the security of his/her username and password and the proper original equipment of his/her computer, which is up-to-date and has anti-virus protection.

Grapak A1 collects the following user information for operational purposes: first and last name, address and place of residence, email address, contact telephone number and other information entered by users on the forms at http://www.shop.grapak.com. Grapak A1 is not responsible for the accuracy of data entered by users.


About cookies and their use

The amended Slovenian Electronic Communications Act (Official Gazette No.109/2012; hereinafter: ZEKom-1), which came into force at the beginning of 2013, introduced new regulations regarding the use of cookies and similar technologies for storing information or access to information stored in the user's computer or mobile device.
